Responding to a lawsuit filed by The Bee and the Los Angeles Times, a judge ruled today that the names of police officers involved in last November's pepper spray incident at UC Davis must be made public.
The order by Alameda Superior Court Judge Evelio Grillo reverses an earlier decision by the judge to allow release of a report into the incident with the names of the officers redacted.
The Federated University Police Officers Association -- the union representing campus police officers -- has been fighting disclosure of the officers' names, arguing that state law prohibits it and that revealing their identities could expose them to harrassment.
But Grillo concluded that the report was separate from any internal affairs investigation into the actions of police officers and is subject to release in full under the California Public Records Act.
"As police officers paid by the public and authorized by the public to excercise authority over individual members of the public, the FUPOA cannot reasonably expect that information about the actions of police officers will be shielded from public scrutiny other than as provided by statute," the judge wrote.
The newspapers sued after University of California officials denied requests under the public records act for the officers' names.
"We're glad the court agrees this information should be available to the public," Joyce Terhaar, The Bee's executive editor, said today. "We continue to believe one of the most important things we do is to hold public officials and other powerful people accountable for their actions.
"That's why we joined this legal effort, to hold everyone accountable for their part in the pepper spraying."
The pepper spraying occurred during a campus protest last fall over tuition hikes and budget cuts, and prompted widespread outcry. Several investigations into the incident were launched, including an independent review overseen by former state Supreme Court Justice Cruz Reynoso.
The Reynoso report became the focus of legal wrangling after the police union went to court to oppose the release of officers' names. Grillo eventually allowed it to be released with only the names of two officers -- Lt. John Pike and then-Chief Annette Spicuzza -- included.

Local Bodies poll in Uttar Pradesh starts from Lucknow today

Lucknow, Jun 23 : The first of five-phase local bodies polls in Uttar Pradesh started this morning with polling in state capital of Lucknow.
State Governor B L Joshi and the former UP chief minister Rajnath Singh were among the prominent persons to cast their votes today.
The election for the mayors and corporators in 12 Nagar Nigam and chairman to 194 Nagar Palikas and 423 Nagar Panchayats in Uttar Pradesh would take place from today till July 4 next with counting of votes to take place on July 7 next. The polling in newly created 13th Nagar Nigam of Saharanpur is not taking place as the delimitation was done only recently.
The election process was to start from June 24 but due to some competitive exams on June 24, the polling for the post of Mayor and corporators in 110 wards in Lucknow was rescheduled for today.
More than 22 lakh voters would excercise their franchise in the local body polls in Lucknow while all preparations were afoot for other phases of polling, the state election commissioner S K Agarwal said.
According to sources, the polling in Lucknow had been smooth and peaceful. (UNI)

Ellen Marshall retires after 18 years at Target. /FOX21: Jeff Womack
COLORADO SPRINGS, COLO. -- On Friday, Ellen Marshall said goodbye to a job she has held for the past 18 years.
Marshall, who has a developmental disability, has overcome everyday challenges in order to be a cart attendant.
"I promised the organization when I came here that I would stay here as long as I was physically able." Marshall said.
Marshall's didablities were caused by spinal meningitis when she was only 13 months old. Marshall had a to to learn to walk and talk all over again.
Marshall is one of the first people to be a part of the Cheyenne Village, a local agency started 41 years ago, by Ellen's parents. Peggy and former Colorado Springs Mayor Andrew Marshall started the village to help adults with developmental diabilities. The organization recieved recognition nationally for its model of service.
"It started becuase of me," Marshall said. "My mom didn't want me to be in an institution all my life."
Marshall lives on her own. She rode Springs Mobility to her job at Target. During her off time Marshall excercise twice a week at the YMCA. She was also a competitive skier for years in the Special Olympics.
Marshall said her job at Target was the "best thing" thing that happened to her in her life becuase she feels like she is contibuting and giving to Taget and the community, according to Jeannie Porter, the Cheyenne Village Marketing Manger.
